Utah Paternity
Unlike Divorces, typically the only issues in Paternity actions are child custody and child support. It is in the best interests of the parties to seek a Paternity Order as soon as possible. In Utah, a noncustodial parent, or alleged biological father in a paternity action, may not rely on statements made by the custodial parent of the child concerning child support unless the statements are reduced to writing and signed by both parties. In Utah, once a Paternity action has been filed, the court will only award up to 4 years of back child support. Oftentimes, the non-custodial parent will have the burden of proving child support payments were made.
